BirCar Terms of Service

These Terms of Service ("Terms") govern your use of the BirCar mobile application ("BirCar", "we", "us"). By creating an account or using BirCar you agree to these Terms. If you do not agree, do not use BirCar.

1. The service

BirCar lets drivers in Azerbaijan contact one another anonymously by entering a vehicle's licence plate and placing an anonymous voice call or sending a message. Phone numbers are never shared between users.

2. Eligibility and accounts

  • You must be legally able to enter into a contract and to drive in your jurisdiction.
  • You register with a phone number verified by a one-time SMS code.
  • You are responsible for activity on your account and for keeping your device secure.

3. Vehicle information and plate ownership

  • You may register licence plate(s) that belong to you. Plate registration uses an honour system.
  • Do not register a plate you do not own. Disputed or duplicate registrations may be reviewed and resolved by our administrators, who may remove a plate from your account.

4. Acceptable use

You agree not to use BirCar to:

  • insult, harass, threaten, defame or intimidate any person;
  • send spam, advertising, scams or repeated unwanted messages;
  • impersonate others or misrepresent your identity or plate;
  • collect or expose another person's private information;
  • use the service for any unlawful purpose or to endanger road safety.

Communication should be limited to legitimate, vehicle-related reasons (e.g. "your lights are on", "you are blocking my car").

5. User-generated content

You are solely responsible for the calls you make and the messages you send. You grant us the limited right to transmit, store (where applicable), and moderate your content to operate the service. We do not tolerate objectionable content or abusive behaviour. There is zero tolerance for harassment, threats and abusive content.

6. Moderation, reporting and blocking

  • We use automated and manual moderation (including message risk scoring, fuzzy matching, spam detection and rate limiting) to detect and prevent abuse.
  • Messages that contain abusive content may be warned about or blocked before sending. Predefined official quick messages are always allowed.
  • You can report other users (spam, harassment, offensive language, threats, advertising, other) and block them.
  • Reported and confirmed-abusive accounts may receive warnings, message muting, temporary suspension or a permanent ban at our discretion.

7. Ratings and reputation

After calls, users may leave star ratings and feedback tags. Ratings contribute to a driver's public reputation score and are used to encourage respectful behaviour. Ratings must be honest and must not be used to harass.

8. Notifications

BirCar sends push notifications for incoming calls, messages and administrator announcements. You can manage notifications in your device settings.

9. Account deletion and termination

  • You may delete your account at any time from Profile → Delete account, confirmed by a one-time SMS code. Deletion is permanent.
  • We may suspend or terminate your account if you violate these Terms or applicable law, or to protect users.

10. Disclaimers

BirCar is provided "as is" and "as available". We do not guarantee that calls or messages will always be delivered, or that the service will be uninterrupted or error-free. BirCar is a communication tool and is not an emergency service — in an emergency, contact the relevant authorities directly.

11. Limitation of liability

To the maximum extent permitted by law, BirCar and its operators are not liable for indirect, incidental or consequential damages, or for the conduct of other users, arising from your use of the service.

12. Changes

We may update these Terms. Material changes will be notified in the app. Continued use after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the Republic of Azerbaijan, without regard to conflict-of-laws rules.
